1. Agreement to Terms
Welcome to Get3DPrints.com ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, services, and 3D printing manufacturing services (collectively, the "Services").
By accessing or using our Services, submitting files for printing, or placing an order, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing our Services.
We reserve the right to modify these Terms at any time by posting the revised Terms on our website with a new "Last Updated" date. We will provide notice of material changes via email or prominent website notice at least 30 days before the effective date. Your continued use after the effective date constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our Services.
1.1 Age Requirement
You must be at least 18 years of age or the age of majority in your jurisdiction to use our Services. By using our Services, you represent and warrant that you meet this age requirement. If you are under 18, a parent or legal guardian must accept these Terms on your behalf and will be responsible for your use of the Services and any charges incurred.
1.2 User Responsibility for Legal Compliance
You are solely responsible for ensuring that your designs, materials, and intended use comply with all applicable federal, state, and local laws and regulations. Certain designs, materials, or applications may be restricted or prohibited in your jurisdiction. We make no representations regarding the legality of any item in your location and assume no liability for your compliance with applicable laws.
2. Intellectual Property Rights and Copyright Policy
2.1 User Representations and Warranties
By submitting any 3D model file, design, or other content to our Services, you represent and warrant that:
- You are the original creator and copyright owner of the submitted design, OR
- You have obtained explicit written permission from the copyright holder to reproduce, manufacture, and distribute the design, OR
- The design is in the public domain or licensed under terms that permit commercial reproduction
- Your submission does not infringe upon any patent, trademark, trade secret, copyright, or other intellectual property rights of any third party
- You have the legal right and authority to grant the licenses described in these Terms
- The design does not contain any illegal, defamatory, obscene, or offensive content
2.2 Prohibited Content
You may NOT submit designs that include or infringe upon:
- Copyrighted characters, logos, or designs (e.g., Disney, Marvel, DC Comics, Star Wars, Pokemon, licensed video game characters)
- Registered trademarks or service marks of any company or organization
- Patented designs or inventions without proper licensing
- Brand logos, product replicas, or counterfeit goods
- Weapons, weapon components, firearm parts, or items prohibited by local, state, or federal law (including ATF-regulated items)
- Items intended to facilitate illegal activity
- Currency, stamps, or government identification documents
- Designs that violate third-party rights of privacy or publicity
- Medical devices, implants, or prosthetics
- Safety-critical or life-supporting components
- Load-bearing structural parts for vehicles, aircraft, or buildings
- Items intended for use in critical automotive, aerospace, or industrial applications
2.2A Prohibited Safety-Critical Applications
IMPORTANT SAFETY NOTICE: Our 3D printed items are NOT suitable for and must NOT be used in:
- Medical devices or components that contact the human body
- Life-supporting or life-sustaining equipment
- Critical structural components (e.g., load-bearing brackets, mounting hardware for heavy equipment)
- Automotive safety systems (e.g., brake components, steering parts, safety restraints)
- Aerospace or aviation components
- Pressure vessels or containers for hazardous materials
- Electrical enclosures or components where failure could cause fire, shock, or injury
- Weapons, firearms, or firing mechanisms
- Any application where failure could result in death, serious injury, or significant property damage
3D printed items have inherent limitations including layer adhesion weaknesses, material inconsistencies, and unpredictable failure modes. You acknowledge that FDM printing is NOT suitable for critical applications and agree not to use our products in any safety-critical capacity.
2.3 Right to Refuse Service
We reserve the absolute right to refuse, cancel, or terminate service at any time, with or without cause, with or without notice, including but not limited to:
- Designs that we reasonably believe infringe upon third-party intellectual property rights
- Files that appear to be copyrighted characters or trademarked designs
- Requests that lack proper documentation of ownership or licensing rights
- Orders that we deem potentially illegal, unethical, unsafe, or prohibited
- Weapon components, regulated items, or ATF-controlled designs
- Safety-critical applications that could pose risk of injury or death
- Items that violate our prohibited use policy
- Customers with a history of submitting infringing content
- Any order or customer for any reason at our sole discretion
We may, at our sole discretion, request proof of ownership or licensing rights before fulfilling any order. Failure to provide adequate documentation within 7 business days will result in order cancellation and refund. We reserve the right to suspend or terminate your access to our Services and refuse all future orders without explanation.
2A. File Upload Agreement
When you upload a design file to our Services, you agree to and are bound by our File Upload Agreement, which includes the copyright acknowledgment and indemnification terms presented at the time of upload. This agreement is incorporated by reference into these Terms of Service and is legally binding.
2A.1 No Guarantee of Confidentiality
While we implement security measures to protect your files, we cannot and do not guarantee absolute confidentiality or security during transmission or storage. You acknowledge that:
- Internet transmissions are never completely secure
- Unauthorized third parties may potentially intercept or access your uploads
- We are not liable for unauthorized access to your files
- You should NOT upload trade secrets, proprietary information requiring NDA-level protection, or highly confidential designs
- You assume all risk associated with file transmission and storage
If your design requires absolute confidentiality or trade secret protection, do not use our Services. We recommend consulting with a patent attorney before uploading potentially patentable designs.
3. Indemnification and Hold Harmless
IMPORTANT: You agree to indemnify, defend, and hold harmless Get3DPrints.com, its owners, officers, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:
- Your violation of these Terms of Service
- Your violation of any intellectual property or other rights of any third party
- Any claim that your submitted design infringes upon copyright, trademark, patent, trade secret, or other proprietary rights
- Your misrepresentation of ownership or licensing rights
- Any legal action brought by third parties related to content you submitted
- Your use of the printed items in violation of applicable laws or regulations
- Any injury, death, or property damage resulting from your use or misuse of printed items
- Your use of printed items in prohibited or safety-critical applications
- Design flaws, dimensional errors, or suitability issues with your submitted files
This indemnification obligation will survive termination of these Terms and your use of our Services. You agree to cooperate fully in the defense of any claim and we reserve the right to assume exclusive control of the defense and settlement of any matter subject to indemnification.
4. DMCA Copyright Infringement Policy
Note on Service Type: Get3DPrints.com is a private manufacturing service. We do not publicly display, host, or publish user-submitted content. However, we maintain DMCA compliance procedures for safe harbor purposes under 17 U.S.C. § 512.
4.1 Notification of Infringement
Get3DPrints.com respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our Services, please notify our designated DMCA agent with the following information:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material claimed to be infringing, with sufficient detail to locate it
- Your contact information (address, telephone number, email address)
- A statement that you have a good faith belief that the use is not authorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner

4.3 Counter-Notification
If you believe your content was wrongly removed due to a DMCA notice, you may file a counter-notification containing:
- Your physical or electronic signature
- Identification of the material that was removed
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, telephone number, and consent to jurisdiction in your district
4.4 Repeat Infringer Policy
We maintain a policy of terminating accounts and denying service to users who are repeat infringers of copyright. Users who submit three (3) or more infringing items will be permanently banned from our Services.
5. License Grant to Company
By submitting a design file to our Services, you grant Get3DPrints.com a limited, non-exclusive, royalty-free license to:
- Reproduce your design solely for the purpose of manufacturing your order
- Store your file securely for a period of 90 days after order completion
- Modify or prepare derivative works only to the extent necessary to ensure printability (e.g., adding support structures, scaling, orientation)
We will NOT use your designs for any other purpose, share them with third parties, or create products for resale without your explicit written permission. All customer files are treated as confidential business information.
6. Orders, Pricing, and Payment
6.1 Quote Accuracy
Our instant quote calculator provides estimated pricing based on automated file analysis. While we strive for accuracy, the final price may vary if manual review reveals additional complexity, support requirements, or printability issues. We will notify you of any price changes exceeding 15% before proceeding with production.
6.2 Order Acceptance
Submission of a quote request does not constitute a binding order. Orders are not final until we send written confirmation of acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected intellectual property infringement, safety concerns, legal issues, prohibited applications, or items we determine to be unsuitable for 3D printing.
6.3 Payment Terms
Payment is required in full before production begins. We do not extend credit or accept purchase orders without prior written approval. We are a prepayment-only service—manufacturing will not commence until payment is successfully processed and cleared.
We accept major credit cards, debit cards, and PayPal. All prices are in U.S. Dollars (USD). Sales tax will be collected in states where we have nexus or are required by economic nexus laws, calculated based on your shipping address.
Payment Processing: Payments are processed through third-party providers (Stripe and/or PayPal). By making a payment, you agree to their respective Terms of Service. We do not store complete credit card information on our servers. Failed payments may result in order cancellation. Chargebacks or payment disputes must be resolved directly with your payment provider, though we reserve the right to refuse future service to customers who initiate invalid disputes.
Net Terms (Business Accounts Only): Approved business customers may request NET 30 payment terms by contacting support@get3dprints.com with business credentials, tax ID, and trade references. Net terms are granted at our sole discretion and may be revoked at any time. Late payments incur a 1.5% monthly finance charge (18% APR).
6.4 Cancellations and Refunds
Orders may be cancelled for a full refund before production begins. Once printing has started, orders cannot be cancelled. Refunds for defective prints or shipping damage will be issued at our discretion after evaluation of photographic evidence.
No Refunds for User Error: Refunds will NOT be issued for:
- Design flaws or errors in your submitted file
- Files that are unprintable or unsuitable for 3D printing
- Misunderstanding of scale, dimensions, or size
- Items that do not meet your expected strength, finish, or performance requirements
- Items that are unsuitable for your intended application
- Customer dissatisfaction with inherent characteristics of FDM printing (layer lines, surface texture, etc.)
- Dimensional variance within our stated tolerances (±0.5mm)
- Color variations between batches or materials
You are responsible for verifying that your design is correct, printable, and suitable for your intended purpose before placing an order.
7. Product Quality and Specifications
7.1 Print Quality Standards
All prints are produced using professional FDM (Fused Deposition Modeling) 3D printing technology. Visible layer lines, minor stringing, and slight variations in color are inherent characteristics of FDM printing and are not considered defects.
7.2 Dimensional Accuracy
We maintain dimensional accuracy within ±0.5mm (±0.02 inches) for most prints. Larger models or those with fine details may have greater variance due to material shrinkage and thermal properties.
7.3 Material Properties
Material properties (strength, flexibility, temperature resistance) are approximations based on manufacturer specifications. Actual performance may vary based on design geometry, print orientation, and environmental conditions. We make no warranties regarding specific mechanical properties unless explicitly agreed in writing.
7.4 File Modifications and Print Orientation
We reserve the right to make modifications to your design file to ensure printability, including:
- Adding, removing, or modifying support structures
- Adjusting print orientation for optimal strength and finish
- Repairing mesh errors, holes, or non-manifold geometry
- Scaling to fit within our build volume (340mm × 320mm × 340mm)
- Choosing infill density, wall thickness, and layer height
- Selecting print settings to balance speed, strength, and quality
Important: Our choice of print orientation and settings significantly affects part strength, surface finish, and dimensional accuracy. These decisions are made at our discretion based on our manufacturing expertise. You acknowledge and accept that:
- Print orientation affects layer adhesion and directional strength
- Parts may be weaker along layer lines
- Surface finish varies by orientation
- We are not liable for strength limitations inherent to our chosen print orientation
Significant changes requiring design alterations will be communicated before production. You accept our manufacturing decisions as final.
7.5 User Responsibility for Warnings and Labels
YOU ARE SOLELY RESPONSIBLE for providing appropriate warnings, labels, instructions, and safety information for the printed items you receive. We provide manufacturing services only and do NOT provide:
- Safety Warnings: We do not provide warnings about potential hazards, dangers, or unsafe uses of printed items
- Hazard Labels: We do not provide choking hazard warnings, flammability warnings, or other required consumer product labels
- Age-Appropriateness Ratings: We do not assess or certify age suitability for toys, games, or children's products
- Usage Instructions: We do not provide operational manuals, assembly instructions, or user guides
- Material Safety Data: We do not provide MSDS sheets, toxicity information, or end-use safety certifications
- Testing or Certification: We do not test products for safety, durability, or compliance with consumer product standards (CPSC, ASTM, EN71, etc.)
- Regulatory Compliance Documentation: We do not provide CE marking, FCC compliance, or other regulatory certifications
If you distribute, sell, gift, or provide printed items to others, you must:
- Comply with all applicable consumer protection laws, including the Consumer Product Safety Act (CPSA), Federal Hazardous Substances Act (FHSA), and state product liability laws
- Provide adequate warnings and instructions for safe use
- Test products for safety if required by law (e.g., children's products under 12 years old)
- Obtain necessary certifications (e.g., Children's Product Certificate for toys)
- Register with appropriate authorities (e.g., CPSC for children's product manufacturers)
- Maintain adequate product liability insurance
- Establish recall procedures in case of safety defects
Disclaimer: We are a contract manufacturer providing made-to-order manufacturing services. You are the product designer, developer, and responsible party for all product safety, testing, labeling, and regulatory compliance. We are not liable for injuries, deaths, property damage, or regulatory violations resulting from your failure to provide adequate warnings, testing, or compliance documentation.
7.6 Material-Specific Warnings and Limitations
Each material has specific limitations and characteristics you must understand before ordering:
PLA (Polylactic Acid) - Standard Plastic:
- Heat Limit: Softens at ~60°C (140°F) - NOT for hot environments, dishwashers, or vehicles
- Durability: Biodegrades over time with moisture and UV exposure - NOT for long-term outdoor use
- Impact Resistance: Brittle under impact - NOT for drop-resistant applications or protective equipment
- UV Degradation: Yellows and weakens in direct sunlight over months
- Best For: Indoor decorative items, prototypes, short-term use items, gifts
PETG (Polyethylene Terephthalate Glycol) - Durable Plastic:
- Food Safety: NOT food-safe unless certified food-grade PETG used (specify in notes) - layer lines harbor bacteria
- Hot Liquids: NOT for hot beverage containers - warps at ~80°C (176°F)
- Chemical Resistance: Swells or dissolves in acetone, strong acids, and some solvents
- Hygroscopic: Absorbs moisture from air, affecting dimensional stability
- Best For: Functional parts, mechanical components, outdoor items (limited), protective cases
ABS (Acrylonitrile Butadiene Styrene) - Tough Plastic:
- Fumes: Releases styrene fumes during printing (we ventilate properly) - may have slight odor on delivery
- Warping: Prone to warping and cracking during printing - may affect dimensional accuracy
- UV Sensitivity: Yellows and degrades in sunlight - requires UV-resistant coating for outdoor use
- Living Hinges: NOT suitable for living hinges or repeated flexing - will crack
- Best For: Heat-resistant parts, automotive interior components, electrical enclosures
ASA (Acrylonitrile Styrene Acrylate) - UV-Resistant Plastic:
- UV Resistance: Better than ABS but NOT 100% UV-proof - will degrade over years
- Water Resistance: Moisture-resistant but NOT waterproof - water can seep through layer lines
- Stress Cracking: Can crack under sustained stress or impact - NOT for structural load-bearing
- Temperature: Good heat resistance but NOT for extreme temperatures (>90°C or <-30°C)
- Best For: Outdoor signage, planters (with drainage), automotive exterior trim, garden fixtures
TPU (Thermoplastic Polyurethane) - Flexible Rubber-like:
- Precision: NOT for high-precision parts - flexes during printing affecting dimensional accuracy (±1-2mm typical)
- Chemical Resistance: Degrades in oils, greases, and petroleum products - NOT for automotive or machinery applications
- Structural Use: NOT for load-bearing or structural applications - compresses and deforms under sustained load
- Temperature Range: Limited temperature resistance (-30°C to 60°C)
- Best For: Gaskets, seals, phone cases, soft-touch grips, vibration dampeners
Nylon (Polyamide) - Engineering-Grade Plastic:
- Moisture Absorption: Absorbs water from air (hygroscopic) - dimensions change 0.5-2% with humidity changes
- Precision Applications: NOT for precision parts without post-treatment (annealing or sealing)
- Warping: High warping tendency - may affect final dimensions and flatness
- Post-Processing Required: Often requires annealing (heating) to stabilize dimensions - additional cost may apply
- Best For: Gears, bearings, bushings, wear-resistant parts, functional prototypes
⚠️ ALL MATERIALS - UNIVERSAL FDM LIMITATIONS:
- Anisotropic Properties: FDM printed parts are WEAKER along layer lines than across layers - strength varies by print orientation
- Layer Adhesion: Parts can delaminate (split along layers) under stress, impact, or temperature changes
- NOT for Safety-Critical Applications: Medical devices, life-support equipment, aircraft components, safety equipment, load-bearing structures, automotive safety parts
- NOT for Pressure Vessels: Layer lines create leak paths - NOT watertight without post-processing
- Voids and Imperfections: All parts may contain internal voids, inconsistent infill, or micro-cracks invisible to the eye
- No Warranty for Strength: We make NO WARRANTIES regarding tensile strength, impact resistance, fatigue life, or load-bearing capacity
- Testing Required: If using for mechanical or functional applications, YOU must conduct appropriate testing to verify suitability
By placing an order, you acknowledge: You have read and understand the material-specific limitations and FDM technology constraints. You accept full responsibility for determining suitability for your intended use. You will not use printed items for safety-critical, medical, food-contact (unless certified), or load-bearing applications without proper testing, certification, and assumption of all associated risks.
8. Shipping and Delivery
8.1 Shipping Methods
We ship via USPS or UPS based on package size and destination. Shipping costs are calculated based on weight, dimensions, and delivery address. International shipping is not currently available.
8.2 Delivery Timeframes
Estimated production time ranges from 3-10 business days depending on order complexity and queue volume. Shipping time varies by carrier and destination (typically 3-7 business days for domestic orders). We are not responsible for carrier delays beyond our control.
8.2A Force Majeure
We are not liable for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, quarantine restrictions, strikes or labor disputes, shortages of transportation facilities, fuel, energy, labor or materials, supplier delays, equipment failures, or Internet/telecommunications outages. In such events, our performance obligations will be suspended for the duration of the force majeure event.
8.3 Shipping Damage
Items are carefully packaged to prevent damage during transit. If your order arrives damaged, photograph the damage and packaging immediately and contact us within 48 hours. We will work with you to file a carrier claim or arrange a replacement.
9. Limitation of Liability and Disclaimers
9.1 Disclaimer of Warranties
OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR FREEDOM FROM DEFECTS.
We specifically disclaim any warranty that:
- Products will meet your specific requirements or be suitable for your intended use
- Products will be uninterrupted, timely, secure, or error-free
- Results or output will be accurate or reliable
- Quality will meet your expectations
- Any errors will be corrected
- Our services will be compatible with your files or equipment
- Products will be free from defects inherent to FDM 3D printing technology
You acknowledge that 3D printed items manufactured from user-provided designs may contain errors, inaccuracies, or defects for which we are not responsible. We do not warrant that your design is suitable for 3D printing or fit for any particular purpose.
State-Specific Rights: Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. You may have other rights that vary by state or jurisdiction. Nothing in these Terms limits any rights you may have that cannot be legally waived.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GET3DPRINTS.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use our Services
- Any unauthorized access to or use of your files or data
- Any errors or omissions in any content or materials
- Claims of intellectual property infringement by third parties
- Product defects, failures, or performance issues
- Design flaws or suitability issues with user-provided files
- Injuries, death, or property damage from use of printed items
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS LESS.
9.3 Use at Your Own Risk
You acknowledge that 3D printed items have inherent limitations and may not be suitable for all applications. You are solely responsible for determining whether printed items meet your requirements and for any consequences of their use. We are not liable for injuries, damages, or losses resulting from use, misuse, or failure of printed items.
10. Privacy and Data Security
10.1 Personal Information
We collect personal information (name, email, address) necessary to fulfill your order. This information is stored securely and used only for order processing, shipping, and customer communication. We do not sell or share your personal information with third parties except as required for order fulfillment (e.g., shipping carriers).
10.2 Design File Security and Retention
All uploaded design files are transmitted via secure HTTPS connections and stored in encrypted AWS S3 storage. Files are retained for 90 days after shipping confirmation. Files from cancelled or incomplete orders are deleted within 30 days. We may delete files earlier at our sole discretion without notice. We implement industry-standard security measures, but cannot guarantee absolute security against unauthorized access.
10.3 Cookies, Analytics, and Electronic Communications
Our website uses Google Analytics to track visitor behavior and improve user experience. By using our Services, you consent to this data collection. You may disable cookies in your browser settings, though this may affect website functionality.
Electronic Communications Consent: By providing your email address, you consent to receive electronic communications from us, including order confirmations, shipping notifications, quote responses, and service-related announcements. You may opt out of promotional emails by following the unsubscribe link, but you cannot opt out of transactional emails related to your orders.

11. Dispute Resolution and Governing Law
11.1 Informal Resolution
If you have a dispute or concern, please contact us first at support@get3dprints.com. We commit to working in good faith to resolve issues informally within 30 days.
11.2 Binding Arbitration Agreement
IMPORTANT: PLEASE READ THIS ARBITRATION AGREEMENT CAREFULLY
By agreeing to these Terms, you are agreeing to resolve disputes through binding arbitration instead of in court. This means:
- You WAIVE your right to a jury trial
- You WAIVE your right to have a judge decide your dispute
- Discovery and appeal rights may be more limited than in court
- Arbitrator decisions are final and binding with very limited review
- You CAN still bring claims in small claims court if they qualify
Any dispute, claim, or controversy arising from or relating to these Terms, your use of our Services, or any order you place that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Weber County, Utah, or at another mutually agreed location. The arbitration may be conducted in person, through document submission, by phone, or by videoconference as determined by the arbitrator.
Arbitration Costs: Each party shall bear its own attorneys' fees unless the arbitrator awards fees as permitted by law. For consumers, AAA's Consumer Arbitration Rules govern payment of arbitration fees. If your claim is for $10,000 or less, we will reimburse your filing fee and pay the arbitrator's and hearing fees.
11.2A Opt-Out Right
YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION AGREEMENT
If you do not wish to be bound by this arbitration provision, you must notify us in writing within 30 days of first accepting these Terms. Send your opt-out notice to: support@get3dprints.com with subject line "ARBITRATION OPT-OUT" and include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration. If you opt out, you may pursue your claims in court, but all other Terms still apply.

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive the right to participate in any class action lawsuit or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the laws of Utah, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration must be brought in the state or federal courts located in Weber County, Utah.
